‘My daughter was raped by boy, 15 — then teachers put him in same class’

The alleged victim's mother complained that her daughter's needs were not taken into account

A mother has attacked a school for allowing a pupil back into class after he allegedly raped her 16-year-old daughter.

The mother, Mandy, said her daughter Emily* was allegedly assaulted by a 15-year-old pupil at a weekend party.

She reported the incident to police and the boy was arrested and released on bail, on condition that he made no contact with his alleged victim.

Mandy said: “He swans back into school the next day and the school, which is run by four male senior managers, thinks it’s absolutely okay to stick him in the same classroom.

"They just didn’t get it. They kept saying he’s innocent until proven guilty and he has a right to an education. It was unbelievable that only his needs were taken into account.”

Emily and her alleged attacker are now at separate sixth-form colleges and school governors “partially upheld” a complaint against the senior leadership team.

Mandy said she was considering civil action against the school because the family felt it was the only way to get the guidance strengthened over assault among pupils. “If I take them to court, and they run the risk of having to pay out for personal injury, then they’ll legislate,” she said. “We’ve got 17,500 schools, why are we expecting all those senior managers to get this right?

“Unless it’s set out for schools, they just make it up as they go along. And they will get it wrong time and time again because they’re out of their depth. The potential for retraumatisation for Emily was massive.”

A police spokesman said a boy of 15 had been arrested in March, but no further action had been taken.
