Neighbours in feud over gravel strip may go to Supreme Court

A seven-year row between neighbours over a narrow strip of courtyard in Peckham could reach the Supreme Court.

The dispute, which has cost up to £50,000 in legal fees so far, began in 2005 when Angela Boggiano, 45, and Craig Robertson, 43, put up a white picket fence.

It ran along what they say is the boundary between the back of their terrace home and the front of Devon Cameron's mews house.

In 2007, they replaced the fence with a wall, and plant pots were put along a gravel strip measuring 10ft by 2ft which Mr Cameron, 48, contends is his. After each side sued in a six-day hearing, the High Court found that plans indicated Mr Cameron could not lay claim to the strip.

At the Appeal Court yesterday, Mr Cameron challenged the ruling and lost, while his rivals won their case that he had no claim to ownership. Mr Cameron said: "I am considering the option of The Supreme Court."

Lord Justice Mummery said there were only ever losers and "human misery" when neighbours go to war, and it was "highly regrettable" the case about "a gravel strip of small size and little money value" got to court at all.

He added: "Bad feelings all round do not finish with the final judgment," and warned: "The only certainty in this kind of case is that the financial outlay is almost always more than the disputed property is worth."

Both sides were asked to try to agree between themselves how the legal bill should be covered. If they fail, a further court order will be necessary.
