Plea to hear Molly case in Scotland

Lawyers in the tug-of-love battle over a 12-year-old girl who ran away to Pakistan to be with her father argued over where the custody hearing should be held.

Molly Campbell, also known as Misbah Rana, fled the Western Isles in August to live in Lahore with her father Sajad Ahmed Rana. Mr Rana was recently given temporary custody of his daughter by the Pakistani authorities until October 21.

But the girl's mother, Louise Campbell, who was awarded custody of her daughter in the UK last year, is fighting to get the youngster back with her in Stornoway, Lewis.

She has lodged a petition at the Lahore court alleging Molly was illegally taken to Pakistan by her former husband and eldest daughter.

At a hearing at the High Court in Lahore, lawyers were asked if Mrs Campbell would be able to attend further hearings. Naheeda Mahboob Elahi, the lawyer acting for Mrs Campbell, also said that both sides argued over where the full custody hearing should be held - in Scotland or in Pakistan.

She said later: "The case has been adjourned until tomorrow. They've asked me to find out if Louise can come to Pakistan. There was a lot of arguments. My argument was for the Court of Session in Scotland to hear the case."

She said as Scottish courts had made Mrs Campbell Molly's guardian, her father should not have taken her out of the country. "My main argument is that the laws have to be followed," she said following the hearing.

Last week Molly was filmed in Pakistan saying she suffered racial abuse while she lived in Scotland, adding that she never wanted to go back.

But Glasgow councillor Hanzala Malik, who is also from Pakistan, criticised overseas courts for taking up cases that had already had a ruling in the UK. He said they made the British courts system look "like a laughing stock".

Mr Malik said he was concerned decisions made by UK courts regarding vulnerable people were not being honoured.
